Điều 5 Nghị định số 361/2025/NĐ-CP quy định về phê duyệt vị trí việc làm công chức như sau:
1. Cơ quan sử dụng công chức lập hồ sơ đề nghị phê duyệt vị trí việc làm của cơ quan mình, gửi cơ quan tham mưu về tổ chức cán bộ của cơ quan có thẩm quyền phê duyệt vị trí việc làm để rà soát, tổng hợp. Hồ sơ gồm có:
a) Văn bản đề nghị phê duyệt vị trí việc làm;
b) Danh mục vị trí việc làm được sử dụng trong cơ quan, tổ chức;
c) Job description, capacity framework of each job position;
d) Propose the proportion of civil servants arranged according to each job position.
2. The personnel organization advisory agency of the competent authority approving the job position is responsible for reviewing and summarizing and submitting to the competent authority approving the job position for consideration and decision.
In case when receiving the dossier requesting job position approval but the composition does not meet the regulations in Clause 1 of this Article, within 3 working days, the staff organization advisory agency has a written request for the civil servant use agency to complete the dossier according to regulations.
3. Within 30 working days from the date of receiving sufficient dossiers requesting job position approval, the advisory body on personnel organization must complete the review, synthesis, and report to the competent authority approving the job position for consideration and decision. The review content includes:
a) The suitability of the job position list is determined compared to the functions and tasks of agencies and organizations according to the regulations of competent authorities;
b) The suitability of the job description, capacity framework for each job position compared to the functions, tasks, management scale, nature, and task requirements of the agency using civil servants;
c) The proportion of civil servants to be arranged according to each job position.
4. Within 10 working days from the date of receiving the written report from the advisory body on personnel organization, the competent authority approving the job position issues a decision approving the list of job positions of the agency using civil servants, and at the same time sends it to the Ministry of Home Affairs for general synthesis and monitoring.
